Health and Safety in sport: do you understand your legal liabilities?

Have you ever heard of the Health and Safety in Sport Act? If not, that’s because it doesn’t actually go by that name, rather, it is called the Heath and Safety in Employment Act 1992 (The HSE Act). With paid professionals now becoming more common in the sporting arena it may not seem that surprising if I told you that the HSE Act had implications in sport. But what if I told you that its ambit went far beyond the bounds of professional sport and has far reaching implications in amateur sport? Surprised? If you are, then I’m not surprised by your reaction, since it is exactly that reaction I have been getting when I talk about the HSE Act as part of the Sports Risk Management’s Group’s Sports Liability Seminar being run up and down New Zealand.
